Nick Sinatra, the real estate developer who has been acquiring properties primarily in North Buffalo and Kenmore, has struck a deal to buy the Market Arcade Building from the city for $1.4 million, with plans to relocate his firm’s headquarters to the downtown site.

Sinatra & Co. Realty has agreed to buy the three-building complex at 615-623 Main St., in the Theatre District, from the Buffalo Urban Renewal Agency, which currently holds title to the property. The deal was negotiated at fair market value, based on “substantial due diligence” by Sinatra and following a “thorough and competitive” request-for-proposals process, according to a memo, from agency general counsel Scott C. Billman to the oard. A copy was provided to The Buffalo News.

Under the agreement with Sinatra, the firm will relocate its main offices from its current home at 3350 Delaware Ave. in Kenmore and will invest in significant capital improvements, including restoring the interior and exterior facades. Public access to the building, including the first floor “thoroughfare,” will be maintained.

Agency directors will vote on the proposal at their meeting today. If approved, and if a final contract is signed, it will be forwarded to the Common Council for final action.

Sinatra and Buffalo Strategic Planning Director Brendan Mehaffy both deferred comment until the meeting.

Formally known as the Palace Arcade, the three-story Market Arcade building was built in 1892 by G.B. Marshall and designed by E.B. Green and William S. Wicks, who modeled the neoclassical and beaux-arts building after London’s Burlington Arcade. It was named for the bustling public market that once existed at Washington and Chippewa streets nearby, and it was later owned by G.B. Mathews, a flour miller.

Business fell after the end of that market, tenants left, and the building was closed in the late 1970s.

The city took the building over in 1985, did an extensive $10 million renovation in the 1990s and reopened it in 1995 with restored marble, stone, brick and terra cotta, as well as Corinthian columns and more elaborate and intricate ornamental features on the facade. It features a glass-roofed, through-the-block atrium, with entryways to the two adjacent buildings. It remains the city’s only historic covered shopping mall, with shops, restaurants, a gallery and office space lining both sides on all three levels, as well as some residential space in the complex.

Tenants now include Visit Buffalo Niagara, the 3,000-square-foot Buffalo Niagara Visitors Center, CEPA Gallery, Clinton Brown Company Architecture Rebuild, Flynn Battaglia Architects, Perfetto’s Italian Restaurant and the Buffalo Fiscal Stability Authority, or control board.

Most recently, Mazurek’s Bakery opened in the building after city officials approached the South Park Avenue bakery to open its second location.

Last summer, the city decided to put the 76,160-square-foot complex up for sale for $1.8 million after receiving inquiries from potential buyers.

It was listed through Christie R. Nelson, director of the city’s Division of Real Estate and a licensed real estate broker.

State officials have selected Buffalo commercial real estate firms LPCiminelli and McGuire Development Co. as the preferred developers for future high-tech research and manufacturing facilities here – such as RiverBend in South Buffalo – that would be built to bolster the Western New York economy.

The decision to award a five-year contract to the two firms could prove lucrative, since it would appear to guarantee a steady stream of work as the state moves forward with efforts to develop a clean-tech and science-oriented new economy.

Gov. Andrew M. Cuomo is pouring hundreds of millions of state dollars into the region as part of his Buffalo Billion, and advanced manufacturing and “green” technology are a major component.

“Gov. Cuomo’s transformation of the economic development landscape of Buffalo and Western New York is well underway,” Howard Zemsky, co-chairman of the Western New York Regional Economic Development Council, said in a statement.

“The array of high-tech developments the governor has championed holds tremendous promise and opportunity for our region. Getting the development team in place will help us move forward quickly.”

The two firms, which were selected by the SUNY College of Nanoscale Science and Engineering in Albany as the overall project administrator, will have the exclusive development rights for the next five years to construct any state-of-the-art facilities necessary to advance the state’s economic development goals. The “strategic partnership” also would provide for five successive one-year renewal options if all parties agree.

“McGuire Development Co. is excited about this prestigious opportunity to further Gov. Cuomo’s plans to develop high-tech clean-energy research and manufacturing hubs within Buffalo,” said James Dentinger, the company’s chief executive officer. “This is yet another step in the right direction for Buffalo’s economic renaissance, and we’re thrilled to be a part of it.”

Nine developers expressed initial interest in winning developer status, but only six asked for more information and signed confidentiality agreements.

However, it’s still far from clear exactly what work the two developers will be doing, when or where, or how they will work together. Neither the vague press release nor the firms nor the college would identify specific projects or facilities.

The original request for proposals, issued Oct. 15, did not specify what projects the developers would participate in, and the formal contract between LPCiminelli, McGuire, the nanoscale college and SUNY’s Fort Schuyler Management Corp. will not cite particular projects either, according to the announcement.

Still, officials touted the announcement as a major step.

“We look forward to working with both of these highly qualified developers to deliver world class, state-of-the-art facilities for the leading technology companies being lured to Western New York,” Dr. Alain E. Kaloyeros, senior vice president and CEO of the nanoscale college, said in a press release.

The developers will now meet with state officials and negotiate a formal contract.

“We’ve all been watching the governor talk about his vision for nano in Buffalo, and like everyone else, we’ve been very excited about it,” said Kevin Schuler, spokesman for LPCiminelli, which is working with Ciminelli Real Estate Corp. and Hodgson Russ LLP. “To be part of realizing that vision is just a tremendous opportunity.”

So far, Cuomo has unveiled two major projects that together will yield more than $1.5 billion in private investments along with hundreds of millions that the state is investing.

First, Albany Molecular Research Inc., an Albany-based biomedical research firm, is setting up a drug development operation in Ciminelli Real Estate Corp.’s Conventus building on the Buffalo Niagara Medical Campus. It will be joined by Waltham, Mass.-based PerkinElmer, another research company, in what Cuomo has billed as the Buffalo Medical Innovation and Commercialization Hub.

But that is not part of the new five-year contract. That $110 million, seven-story project, which also will house other medical, science and research operations for Kaleida Health and medical practice group UBMD, is already under construction, with an expected completion in spring, 2015. Both LPCiminelli and McGuire are already involved, with LPCiminelli as the construction contractor and McGuire as the representative for UBMD.

More recently, though, Cuomo announced plans for the Buffalo High-Tech Innovation and Commercialization Hub at RiverBend, to house two solar-energy companies, Soraa and Silevo, that will relocate operations from California. The state will invest $225 million in infrastructure, equipment and construction of 275,000 square feet of space in the first of six buildings on an 88-acre former steel manufacturing campus, while the two firms will spend $750 million each and bring 850 jobs.

That project has not yet begun, and is expected to be part of the new contract, along with future concepts that have not yet been announced. Additionally, the state is developing a new Advanced Manufacturing Institute, initially in the former SmartPill headquarters building on Main Street, and the Start-Up New York tax-free zones will encourage other development on and around college campuses.

The historic Buffalo tavern, closed since October after the bankruptcy of its former owner, could reopen as early as mid-April after being purchased by attorney and preservationist Tom Eoannou.

“There was a whole list of people who wanted to buy this building,” Eoannou said Friday. “My purpose was to keep this the way it was, Buffalo’s oldest bar. Essentially, I didn’t want it changed.”

Trying to preserve an irreplaceable piece of the city’s built history, Eoannou said, he negotiated its sale, closing two days ago. He also sought a restaurant tenant who would celebrate its heritage and found Salvatore G. Buscaglia, owner of Snooty Fox Lounge, who hopes to open Ulrich’s 1868 Tavern by mid-April.

The place, at 674 Ellicott St., will be open for lunch and dinner, with a menu offering German, Italian, Polish and other fare, Buscaglia said. The kitchen will be modernized, and a modern 10-tap glycol refrigerated line system is being installed for top beer quality.

Eoannou, who also is restoring the North Park Theatre on Hertel Avenue, said Ulrich’s October closing led him to see if he could buy the building. He described it as a competitive process, with at least one bidder planning to demolish the building for a parking structure.

When it reopens, much of the physical heritage will remain, he said. Details include the hand-cranked elevator used to bring up liquor from the basement during Prohibition, pictures of the Ulrich and Daley families, and the Iroquois Hotel back bar, installed in 1910. “We want to keep everything,” he said.

His decision to buy the building was clinched when he visited Ulrich’s with his father, he said. “My dad, Constantine Eoannou, is 87. He grew up six blocks down. I brought him in, and said, ‘What do you think?’ He said, ‘It reminds me of when I was a kid. It’s not a restaurant, it’s a museum.’ ”

That clinched it, Tom Eoannou said.

Then came months of negotiations, legal research and title insurance to make sure he could buy the building, he said. “Ultimately we were able to secure the title insurance, negotiate a deal with the corporation that owned it, and successfully closed it two days ago.”

Former owner James F. Daley Jr. filed for bankruptcy in August 2012, citing hundreds of thousands of dollars in back taxes owed to New York and the IRS.

Asked what the price was, Eoannou declined to comment. “I made a substantial financial commitment to keep it.”

“My feeling was that this is the oldest bar in Buffalo. It says so much about Buffalo. What’s happening, in my humble opinion, is that there’s this great city resurgence, and it’s not Goliaths, but small guys like me. A lot of us are reaching back into these historic buildings, and that’s part of the resurgence.”

Buscaglia was a master carpenter before he opened Snooty Fox in 2007, and he’s already renovating Ulrich’s.

“My vision is to capture a period in time that would make you feel as if you stepped back into the 19th century,” Buscaglia said. “This place is going to be built right, and it’s going to be built to complement that era.”

A father-and-son real estate development team specializing in multifamily housing is in the process of buying the nine-hole Harris Hill Golf Course in Bowmansville, with a plan to eventually convert it into a high-end apartment complex.

Anthony and Nicholas Cutaia’s Rane Property Management LLC has the 26-acre executive golf course under contract for $1.95 million, with an anticipated closing in the next couple of weeks, Nicholas Cutaia confirmed.

He said the duo plans to continue operating the golf course for the rest of this year, noting that the course, and especially the driving range, are “quite profitable.” They also will seek to populate an adjacent 37,000-square-foot office building that is included in the sale.

Located at 5360 Genesee St., at Harris Hill Road, the property also includes a pro shop and restaurant on the golf course portion, and a pizza parlor on the outparcel along with the office building.

The facilities are currently owned through GG Roncam LLC by Camille B. Surowick, whose husband, Ronald, had purchased and operated them for years but has since died, leaving them to his wife. The asking price was $2.1 million, according to Anthony D’Auria, principal and executive vice president at Waterbourne Real Estate Advisors, who brokered the deal.

“We’re in the very early stages, but our plans are, at least for this year, to operate it as a golf course and fill up the office building,” Nicholas Cutaia said.

That’s not their long-term goal, however. Rane owns and operates the 400-unit Dockside Village Apartments, a luxury apartment complex in East Amherst, as well as Fox Creek Estates, a senior citizens apartment community for independent adults 55 and older, which was built last year at 9500 Transit Road.

Cutaia said he and his father are “very interested” in putting up another “Class A” high-end apartment community on the golf course property, with two-story buildings. However, it would not be as large as Dockside since “it’s a much smaller site.”

He declined to elaborate, noting that the final plans, as well as the ultimate price tag, could change depending not only on what they decide, but also on what the town allows or requires them to do. The site is already zoned as residential but “needs a slight upgrade” in zoning, as well as site plan approval. “It should be a really nice development for that area,” Nicholas Cutaia said. “It’ll really help improve the hamlet of Bowmansville.”

The project came before the Town of Lancaster Planning Board last month but has not yet been set for a rehearing.

Veteran caterer and restaurateur Liz Kolken is selling Quaker Bonnet Eatery and four other Allen Street buildings to Mike Shatzel, an owner of Cole’s and Blue Monk.

Shatzel said he is turning the restaurant, at 175 Allen St., into a place with “wild burgers and a world-class beer list.” He aims to open by June 1.

Quaker Bonnet isn’t going out of business, Kolken said. She’ll move her wholesale, retail and catering operation to 69 Chenango St., where Quaker Bonnet has maintained production space.

Quaker Bonnet Eatery will be closing on March 25, and reopening on Chenango Street on April 7. “We’ll still do retail, takeout lunches, delivery, wholesale, catering and web stuff,” she said.

Kolken is selling five buildings: 173 Allen St., a former Quaker meeting house; 175 Allen St., the Eatery building; 181 Allen, the wooden house next to it; a carriage house in the back and a storage garage. The contract has been signed, she said.

Shatzel, whom she has known since he was three, has been like family, she said. “I went to high school with his mother. I’ve known his father, Dave Shatzel, since the days of Laughlin’s. Michael went to high school with my kids. There’s a sandwich at Cole’s named after my son, and we’ve always had a Shatz on the menu, named after him.”

Why sell?

“I decided that my 70th birthday was coming and I didn’t want to be a landlord anymore,” said Kolken, who bought the buildings in 2002. “I needed time to myself. I have grandchildren now.”

For Shatzel, who grew up in a restaurant family headed by his father, the deal scratched an itch he’s had for decades. He described drinking at Colter Bay as a younger man, and being jealous of the places flooded with crowds from the Allentown Art Festival and St. Patrick’s Day parade.

“It just kind of stuck in me that eventually I have to get a place on Allen,” he said. “This is a dream come true.”

There may have been no better way for transit commissioners to underscore their priorities Thursday than approving the sale of outer harbor lands to two state agencies, while also unveiling a massive new project to replace Metro Rail’s aging escalators.

The decisions amounted to a renewed emphasis on the transit agency’s “core” mission, according to officials of the Niagara Frontier Transportation Authority, as they got out of the waterfront management business that hampered finances for almost 60 years.

“The NFTA has always promised the community it would do the right thing, and the bottom line is this was not part of our core responsibilities of transportation,” Commissioner Peter G. Demakos said of the sale of 354 waterfront acres to the state parks system and the Erie Canal Harbor Development Corp.

Unanimous approval Thursday of the sale of the property for $1 allowed authority officials to turn their attention to moving people, especially those encountering broken down escalators in its underground Metro Rail stations. The Buffalo News detailed those problems Wednesday.

“This is very embarrassing to us, that they keep going down,” Commissioner Henry M. Sloma said while questioning the performance of maintenance contractors. “All of a sudden this is news to us? We didn’t see this coming?

“We should have known about this earlier as opposed to a catastrophic reaction.”

But Thomas George, director of surface transportation, explained problems are bound to occur after a 30-year life span and a major rehabilitation project in 1999. He also noted the system still boasts an 89 percent reliability rate that will jump to 94 percent following repairs to an escalator in University Station. Those figures rank favorably in comparison with other systems around the country, he noted.

But he said vandalism remains a major factor in deterioration of the automated stairways.

“We lose four to six escalators a day primarily due to vandalism by kids jumping on them or riding on the handrails,” he said. “It’s been an ongoing problem for years and years and years. It’s something that’s very challenging for us.”

Other officials pointed to the cold and dampness of the tunnel as well as the debris blown into by trains creating high winds – all problems never encountered at other authority facilities such as Buffalo Niagara International Airport.

George said NFTA engineers and other staff are now preparing a request for proposals that will allow the authority to approve a complete replacement program for most Metro Rail escalators in June, with an eye toward construction starting in spring 2015. The four-year project will initially concentrate on problem stations like Delavan-Canisius College and LaSalle, followed by Allen-Medical Campus.

George also said authority consultants have recommended a “significant increase” in labor and maintenance contracts for the system. Already, he said NFTA staff has enhanced its daily cleaning – and especially sanitizing – of elevators in the stations.

“We have been in cost containment mode for a long time, and perhaps we’re paying the price now,” he said.

The commissioners were able to turn their attention to transportation after selling the waterfront property.

Chairman Howard A. Zemsky summarized the authority’s decades-long effort to relinquish its outer harbor properties by pointing to the promise of responsible stewardship by New York State and preserving public access and control.

“This agreement really assures permanent public access to substantial portions of this property,” he said. “Those aspirations would not be realized under NFTA ownership.

In a key provision, the NFTA is released from all environmental claims on the land except for any willful dumping during its ownership.

Gov. Andrew M. Cuomo announced the historic transfer in September, which includes conveyance of most of the northern acres to the harbor agency while the Small Boat Harbor and Gallagher Beach fall under the aegis of state parks.

The agreement ratified Thursday calls for the NFTA to operate the Small Boat Harbor and Gallagher Beach – increasingly popular waterfront destinations – for one more summer before turning them over to the state in November.

Imagine a Ritz-Carlton Hotel, the biggest condos in Buffalo and a Tiffany’s jewelry store, all in one building, atop a new and much larger Buffalo Niagara Convention Center.

Now put that all in downtown Buffalo, at the foot of Main Street, right next to Canalside. And the building’s already there.

Welcome to Peter F. Hunt’s new high-end vision for Buffalo’s tallest edifice, One Seneca Tower.

At 38 stories, it is the most dominant property in the city, with views that extend throughout Western New York and even as far as Toronto when the skies are clear.

But the former One HSBC Center is also 95 percent vacant and in foreclosure, after its three largest tenants all left, leaving only about 20 small offices on the upper floors and barely any tenant revenue. And that has left many real estate observers such as Hunt, chairman and CEO of Hunt Real Estate – as well as developers and rival property owners – concerned, frustrated and perplexed about what to do.

That’s because there simply isn’t enough office demand to fill up the space. Given the building’s size – 851,000 square feet – and the average pace at which Buffalo’s downtown market takes up empty real estate, it would take 10 to 15 years to absorb it. Also, it would need to be updated to try to meet the needs of today’s tenants.

Experts including the Urban Land Institute already recommended a mixed-use development as the solution, incorporating multiple concepts under one roof. Such a diverse mix is necessary to avoid having 851,000 square feet of space dumped on the local office market at deeply discounted rates, which they say would be a disaster for other buildings.

But the conversion costs would still be large, with most estimates in the tens of millions of dollars, even as high as $100 million. Nevertheless, that’s not stopping local real estate developers and others such as Hunt from kicking around ideas, in hopes of preventing a major building from going dark.

Hunt doesn’t want to just target any clientele. Instead, he wants to use the 38-story structure to fill the gap he sees in the local market for the highest-quality upscale accommodations, living, office space and shopping, all in one building. He even compared it to a 60-story building at 900 Michigan Ave. in Chicago, an older office building retrofitted by one developer into a Four Seasons hotel, condominiums, offices and a smaller high-end mall.

“This is the single best opportunity that exists for stepping up the quality of downtown,” Hunt said.

It’s a concept that appears to be shared by many real estate and development experts locally. “Everyone’s pretty much talking about that same concept,” said William A. Paladino, CEO of Ellicott Development Co. “It’s a big building. We’d need all those uses to really make the project work.”

Indeed, Paladino, whose company is the biggest landlord in the city, said he would almost have to intervene, just to protect his own interests with his other buildings. “When the time comes, we’ll probably take a look at it,” Paladino said. “We probably wouldn’t do the project by ourselves. … There’s only a select few in this market that could do that on their own.”

But it’s also one that not many others are willing or able to pursue. Both Anne E. Duggan, spokeswoman for Ciminelli Real Estate Corp., and Jill A. Pawlik, spokeswoman for Uniland Development Co., said their firms are not involved in any discussions right now.

“Given the size and scope of One Seneca Tower as a redevelopment project, a mixed use seems to make the most sense,” said Paul F. Ciminelli, CEO of Ciminelli Real Estate. “But whoever purchases it or otherwise takes that project on will have to have very patient money, as it will be a massive, long-term undertaking.”

The current owners, New York City-based Seneca One Realty, controlled by Mark H. Karasick and Victor R. Gerstein, are widely expected to just walk away rather than fight the foreclosure and be faced with a $75 million balloon payment next year.

Still, the foreclosure has to move through the courts before the lender or anyone else can take possession through an auction. That could take months.

“At some point in the future, we will take that next step, but nothing’s been done yet,” said the court-appointed receiver, Richard J. Schechter. “We’re in a holding pattern now. We need to get a handle on the situation and let the foreclosure process wind its way through the courts.”

Hunt is more familiar than most people with the intricacies of the tower, and the scope of any effort to revive it. His firm has been working as leasing agents for the building owners since January 2005, and had begun lease renewal negotiations with HSBC Bank USA and law firm Phillips Lytle LLP as far back as 2010 – three years before both leases expired. “When it became clear that it wasn’t going to work out with either of them, … we began to contemplate other usages for that building,” Hunt said. “We knew something was going to happen.”

Hunt no longer has any contractual relationship to the building.

Hunt’s concept entails a “vertical village,” focused on providing several features not already available in the city.

For example, he said, there’s no full-service, five-star hotel. There’s few if any high-end condominiums with large floor plates. And there’s very little new and available top-quality office space that isn’t spoken for. All three could be included. There’s also a dearth of luxury retailers, he said, especially for the hordes of Canadian shoppers. Right now, they flock to the outlets, Walden Galleria, Boulevard Mall and other shopping meccas, but don’t find premium stores such as Tiffany’s, Saks Fifth Avenue or Bloomingdale’s with “immediate brand value,” he said. The same is true for luxury or destination hotels such as Four Seasons or Westin, aside from the boutique Mansion on Delaware. Providing a limited amount of high-end space “would be a huge attraction for this kind of building, with a mixed use, and a real feather in our cap when the pro teams that we’re playing come into town,” Hunt said. “So we think there’s a real place for that.”

Finally, he said, the sprawling lower levels of the building and adjacent plaza area, below the tower, could accommodate a convention center of more than 200,000 square feet, which would have access to the hotel above. That would be significantly larger than the current aging facility. “Now we would be able to compete for sizable conventions, and that would add to life downtown immensely,” Hunt said.

The plaza level also has a full-service commercial kitchen, gallery space and a 350-seat stadium-style auditorium. And there’s attached parking, with 1,200 spaces. “Think about the nightlife you could create there, the activities you could create there,” Hunt said.

The building also already has the capability to host a sophisticated data center, since it did so for HSBC. There is “more redundant power in that building than in any building in the city” and “as good a fiber-optic access as you’re going to find anywhere,” Hunt said.

“All of the ideas would require “substantial changes” to the infrastructure, including reworking the entrance to make a hotel more accessible, and he said he has already priced out the costs. He would not disclose specifics but said it is doable “without exceptional incentives from any government.”

“Does it need updates? Does it need new infrastructure? Absolutely, and we know what they are,” he said. But “you don’t have to build a new building. It’s there.”

Hunt has already pitched his concepts to developers, elected officials and the Buffalo Niagara Partnership, among others. He said there is already “genuine interest,” both local and from out of town, and he predicted that it would take multiple developers and investors to get the job done. Hunt might invest himself “if the right other players were in place,” but “we’re not a developer.”

For now, though, the plan is in limbo along with the building. “This is going to take real money to make this happen. This is not a first-time developer deal,” Hunt said. “This is a significant, serious transaction.”

Another area law firm is re-evaluating its real estate options in advance of its lease coming due, potentially adding to the musical chairs that has already occurred in Buffalo legal circles.

Harter Secrest & Emery LLP, a Rochester-based law firm, is starting to explore whether to keep its Buffalo office in its current home at Fountain Plaza or find new office space to fit its needs.

The firm, with 30 local employees, is now housed in just under 18,000 square feet at 12 Fountain Plaza, where it has been since 2003. Its lease expires in early 2016, so “as many businesses do, they are beginning the process of evaluating all of their options and needs,” said Phil Pantano, a spokesman for the firm.

The firm has not issued a formal request-for-proposals to other landlords or developers, but sources say it has begun reaching out, and may be looking for between 15,000 and 20,000 square feet.

C&S Companies, a Syracuse-based engineering firm, will be the anchor commercial tenant in TM Montante Development’s new Planing Mill project at 141 Elm St. in downtown Buffalo, relocating to double the size of its work space, Montante announced Tuesday.

C&S, with 19 employees, will move from 90 Broadway to the former Spaghetti Warehouse building, taking occupancy in April and adding one job. The firm signed a five-year lease for 6,500 square feet.

Originally the site of the E.M. Hager & Sons Planing Mill, the 43,500-square-foot, three-story brick building was purchased by TM Montante, and will feature 22 apartments along with the 10,800 square feet of commercial space. The $8.1 million adaptive-reuse project, which will preserve historic features of the property while using solar panels and other “clean” technology to power the building, received $259,000 in tax breaks from the Erie County Industrial Development Agency.

“We have a long-standing working relationship with C&S, so we were excited for the opportunity to provide them with a unique location to aid the expansion of their operations in Buffalo,” said TM Montante President J. Timothy Vaeth. “The tenancy at the Planing Mill further strengthens our partnership, and we are looking forward to this new phase of our relationship.”

Founded in 1968, C&S is a national engineering, architectural, planning, environmental and construction firm. It decided to move its local offices because of major growth in its Buffalo-area business.

“Our current offices are overcrowded,” said Timothy F. Hughes, managing principal of the Buffalo office. The move, he said, “demonstrates our commitment to further encourage responsible redevelopment in the City of Buffalo, as well as our commitment to the Western New York community.”

Shipping giant FedEx Corp. is looking to build an enormous distribution center on part of a former Bethlehem Steel Corp. property in Hamburg that could employ more than 500 people after full build-out, according to real estate sources and a town official.

The Memphis-based package delivery company wants to buy a 50.1-acre property near the intersection of Route 5 and Bayview Road, across from the Dock at the Bay Restaurant, sources say. The parcel is on the north side of a 129-acre parcel the steelmaker owned but never built on. It is now owned by Tecumseh Inc.

The property, just south of the Ford Motor Co.’s Buffalo Stamping Plant, was acquired by the Town of Hamburg through a land development corporation nearly three years ago. No agreement has been signed with FedEx, but the proposed contract calls for the company to pay the town $25,000 an acre, or $1.253 million.

FexEx then plans to build a distribution center of more than 300,000 square feet to accommodate a significant increase in its shipping business because of online sales, sources said. The company has four office print and ship stores in the area and currently maintains its big ground transportation operation in Cheektowaga. In the meantime, it’s temporarily seeking to lease some additional space elsewhere in the area for “overflow” work.

Michael J. Bartlett, executive director of the Hamburg Industrial Development Agency, would not identify FedEx by name, saying, “We have a confidentiality agreement with the company we are working with on that site.” But “it’s going to be big,” he said.

Other real estate sources confirmed that the company is FedEx, though the company itself would not comment.

“FedEx continuously evaluates opportunities that can enhance our ability to serve our customers, but, as a matter of policy, we don’t have further information on specific proposals under consideration,” said spokesman David Westrick.

Bartlett said it’s not a done deal, either. “There are some issues that have to be resolved,” he said. “It’s not a slam-dunk.”

In particular, the town and company will be seeking access to the property from Route 5, through the state Department of Transportation. Bartlett said he expects the project would qualify but that it could take a year or more.

“We’re hoping to expedite that,” he said.

Bartlett said he also expected the company to seek tax benefits from the Hamburg IDA and, possibly, from the state Empire State Development Corp.

“It’s not a done deal. It looks good. It’s moving along, but anything can happen,” he said. “I’m optimistic, but I’m cautious.”

FedEx looked at the site “several times” before contacting Hamburg officials. So far, the town has dealt mostly with a corporate site selection firm and more recently an out-of-town developer that was hired by FedEx to handle the project.

Orchard Park-based Krog Corp., an industrial developer that has specialized in former brownfields redevelopment projects, had been the “designated developer” for the site, but that status has expired. Benderson Development Co. also was rumored to be interested in the work, as is contractor R&P Oak Hill.

Though it was owned by Bethlehem Steel, the property was never used for anything industrial, and an environmental review turned up nothing problematic on the site, Bartlett said.

Meanwhile, FedEx Trade Networks Transport & Brokerage Inc., the company’s custom brokerage operation for its international ground service, is in the process of replacing its current facility at 128 Dearborn St. in the Black Rock section of Buffalo.

That operation, which coordinates shipments into Canada and worldwide, will be moving to Riverview Solar Park in Tonawanda, where the company is investing $5.2 million in a new 88,000-square-foot facility that will create 82 jobs, in addition to the 926 workers it already has.

A Cheektowaga senior housing community that was owned by a Central New York company has been acquired by a publicly traded New York City-based real estate investment trust for $12.5 million, but it will still be operated by the same management.

NorthStar Realty Finance Corp., acting through CHTWGA NT-HC1 LLC, bought the Peregrine’s Landing Senior Community at 575 Cayuga Creek Road this week from Peregrine’s Landing LLC, which is owned by Peregrine Senior Living of Syracuse.

The complex features studio and one-bedroom apartments on the first and second floors, with kitchenettes and emergency response systems in the bathrooms of each unit. It also includes St. Therese’s Terrace, a specialized “memory-care” area for individuals with dementia or Alzheimer’s. The campus has a central landscaped courtyard, country store, library, porch and bar-style pool room.

The purchase is designed as a sale-leaseback to refinance the debt on the property, with Peregrine continuing as the operator of the facility as before, said Peregrine principal Mark D. Farchione. The company will also be adding 14 “memory-care” beds to the existing facility, he added. “There’s absolutely no impact on the operations or residents,” he said.

Peregrine is a planner, developer, operator and manager of senior living projects, with a total of eight communities in three states, including six in upstate New York and one each in Georgia and Connecticut. The company has also previously developed or managed communities in Baltimore and in Michigan.

In Cheektowaga, the company took what it described on its website as an “undesirable and undeveloped flood zone property” and invested $6.9 million to develop an assisted-living and memory-care community with financing from the U.S. Department of Housing and Urban Development.

The community is 95 percent occupied and was valued at over $14 million, according to Peregrine’s website.

NorthStar, which is structured as a real estate investment trust, is a diversified commercial real estate investment and asset management company, with over $10.6 billion in assets under management for its investors as of the end of 2013. The company originates, structures, buys and manages commercial real estate debt and securities investments – including mortgages, mezzanine loans, credit tenant and other loans – and also buys and owns properties.

Its property portfolio includes manufactured or mobile home communities, health care complexes, multifamily projects and other real estate. On the health care front, it specializes in independent living, assisted-living and skilled nursing facilities, with 87 properties totaling $578 million in assets in 18 states.

As a developer, Rocco Termini is known for being risky. If his newest business venture is a success, he might also be known for being risqué.

Termini has filed plans with the city for a 3,000-square-foot, two-story restaurant building at 128 Genesee St., near the site where Uniland Development Co. is now building Catholic Health System’s new corporate headquarters and training facility.

The restaurant would specialize in hot dogs. The proposed name? Dog é Style.

Termini’s proposal was approved by the Planning Board this morning. The name is not the only thing about Termini’s latest venture that makes it stand out; Termini plans to build the restaurant using eight to 10 metal shipping containers that can easily be attached to each other.

“It’s a very cool concept, and it’s sustainable. It’s totally green. Everything is recycled,” he said. “Part of the coolness of this whole thing is you walk into a container.”

As unusual as that may sound to city planners, it’s fair to say that a business with a name that has a sexual meaning could gives pause to residents and city officials. But Termini said he is not concerned; he said he believes the name will help, not hurt, business.

“We’re so conservative downtown,” he said. “You’re appealing to younger people. I’m not looking for 70- and 80-year-olds to come there.”

This would be far from the first business to trade on sexual imagery in its name. The restaurant franchise Hooters has been doing it for years. And a perfunctory Google search shows that “Doggie Style” is a business name favored by dog groomers in many cities.

Common Council President Darius G. Pridgen, whose Ellicott District includes the proposed restaurant, said he was not aware of any legal powers city lawmakers have to regulate a restaurant’s name.

“I don’t know of anything legally that would prohibit a person from naming a restaurant anything,” Pridgen said

However, there are ways the Council could hold up a project if there were community objections, and if Council approval of the project were required, Pridgen said.

The Genesee Street restaurant is not on the Council’s agenda yet, and it is possible lawmakers will never have to vote on it, he said.

The new restaurant, sandwiched between two existing buildings, is designed to serve the employees of Catholic Health, who will be moving to the new six-story, 139,000-square-foot complex within six months.

It will be a counter-service place with hot dogs and beer, Termini said: “all kind of hot dogs, gourmet and not, very eclectic.” The restaurant will aim for $5 dog-and-beer specials, he said, and have something for vegetarians. “It’s not going to be your father’s hot dog.”

Termini would not disclose the operator of the new restaurant.

A rendering by BMS Design Studio shows the two levels of the restaurant painted bright blue, with a fenced patio in front of the entrance and a balcony on the upper level where the front is angled outward.

“It’s going to be used to service people who work at Catholic Health just across the street. There’s going to be 800 people working there in six months and there’s no place to eat, so we’re filing a void in the market,” Termini said.

Termini has developed a reputation for historic preservation and adaptive re-use projects in Buffalo, including reviving the Lafayette Hotel and AM&A’s warehouse building downtown.

The use of shipping containers for architectural construction is new to Western New York but not to other parts of the country. Such construction already is being used in Detroit, California, London, Amsterdam, Mexico and other parts of the world.

“It hasn’t been done here in Buffalo. This will be the first one,” Termini said. “It’s being done all over the country.”

In Syracuse, for example, a New York City-based company called SG Blocks will use 115 modified shipping containers to build a mid-rise mixed-use facility, with 36 upscale one-bedroom apartments on the upper floors and commercial space on the first floor, along with covered parking. The company has expressed interest in expanding to the Rochester and Buffalo markets as well.

“There’s a container market in Buffalo, both residentially ... and also retail,” said SG Blocks Chairman and CEO Paul Galvin.

“There’s a lot of in-fill lots in Buffalo that could be green housing, to attract graduate students and retain graduate students from the universities.”

What makes the shipping containers attractive is a combination of how they are built and how plentiful they are throughout the country, making them very cheap to buy and retrofit.

The containers are typically used to transport and store a variety of goods by truck, train and especially oceangoing ships. They are the centerpiece of much of international trade. Ports around the country are filled with stacks of empty containers waiting to be loaded for return trips; many are available for other uses.

“So you have to find something to do with them, and we’re beginning to find uses for them,” Termini said. “There’s millions of these containers available.”

Using shipping containers for construction is both inexpensive and fast. A used container can be purchased for as little as $1,000, and even a new container is rarely more than $6,000. Termini cited a cost of about $4,000 each for what he is buying. And his project can be finished within two months of starting.

“It’s not an expensive project. It’s a very small building,” he said.
